FreshMate Terms of Service

Please read these Terms of Use Agreement ("Agreement", "Terms") carefully before downloading or using the FreshMateapp ("App", "Service"). By downloading, creating an account, or using the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Parties and Subject of the Agreement

This Agreement is entered into electronically between FreshMate("we", "us", "our") and the natural person who downloads/uses the App ("User", "you"). It governs use of the Service, paid subscription terms, and the rights and obligations of the parties.

2. Scope of the Service

FreshMate is a mobile app that lets you track fridge/pantry inventory and expiration dates, add products by scanning market receipts with the camera or by pasting text (OCR), receive reminders for items nearing expiration, share inventory with a household via invite code, and subscribe to FreshMate Premium for expanded limits and features.

Registered account required: Fridge inventory and related core features are available only to signed-in (registered) users; guest or anonymous access is not offered.

The Service is provided on iOS and Android; features may vary by platform, version, and region. FreshMate is not a food safety, health, or nutrition advisory service; it is an organizational tool only (see §11).

3. Eligibility and Account Creation

  • You must be at least 13 years old (or the minimum age in your country) and have legal capacity to enter a binding agreement. If under 18, use with parental/guardian consent.
  • You must provide accurate, current, and complete information at registration.
  • Account creation methods: You may register or sign in using one of the following:
    • Email and password (Supabase Auth)
    • Sign in with Apple (iOS)
    • Sign in with Google (iOS and Android)
  • You may open only one account per person/entity; fake identity or accounts on behalf of others are prohibited.

4. Account Security and Responsibility

  • You are responsible for keeping your password confidential and for all activity under your account.
  • If you suspect unauthorized access, notify support.thedynamicstudios@gmail.com immediately.
  • You may reset your password via the in-app "Forgot Password" flow.
  • You may permanently delete your account anytime via Settings → Delete Account; this is irreversible and triggers deletion of data linked to your account (see Privacy Policy §7).
  • FreshMate is not liable for harm from sharing your password, failing to secure your device, or transferring your account to third parties.

5. Subscriptions, Fees, and Price Changes

5.1 FreshMate Premium

Premium features are offered through auto-renewable subscriptions:

Free-tier limits apply until you subscribe (e.g., up to 10 products in inventory, 3 free OCR receipt scans). These limits may change with notice as the product evolves. Current price, trial period (if any), and benefits are shown in-app before purchase (paywall screen); that information is binding.

5.2 Payments

  • iOS: Purchases are charged through the App Store via your Apple ID.
  • Android: Purchases are charged through Google Play.

Subscription entitlement status is verified with RevenueCat. Stripe is not used; we do not collect or store your credit card details directly.

5.3 Auto-Renewal

Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. Renewal is charged within 24 hours before period end at the then-current price.

5.4 Price Changes and Increases

FreshMate reserves the right to change or increase subscription prices in accordance with applicable law and store (App Store/Google Play) rules, with prior notice. The following applies:

  • Apple App Store:Under Apple's subscription price increase policy, increases below certain thresholds (e.g., no more than once per year, not exceeding 50% of current price or USD 5 for monthly plans, or 50% or USD 50 for annual plans, where local law allows) may be communicated by Apple via email, push, or in-app message and renewal may occur at the new price without additional consent. Above those thresholds or where local law requires explicit consent, you must explicitly agree for the subscription to continue at the new price; otherwise it ends at the current period without renewal.
  • Google Play: Under Google Play policies, existing subscribers are notified of price increases; in some cases explicit consent is required to continue at the new price. Without consent, the subscription may be treated as canceled.
  • Price increase notices are sent directly by Apple or Google (email, push, in-store message); FreshMate may show additional in-app information where store rules allow.
  • Prices for new subscribers do not directly change existing subscribers' prices until renewal under the rules above.
  • Local currency prices may update without notice due to tax, exchange rates, or store commission policies; this is separate from subscription price increase rules and follows standard store practice.

If you do not accept a price increase, your remedy is to cancel; you retain Premium until the end of the current period, then return to the free tier.

5.5 Free Trials

If a free trial is offered, you will be charged for the selected plan when the trial ends unless you cancel before it ends. Trial eligibility is determined by Apple/Google (typically once per account). When you move to a paid subscription, any unused trial ends.

5.6 Cancellation and Refunds

  • Cancellation: Manage or cancel via iOS Settings → Apple ID → Subscriptions or Google Play → Subscriptions. Deleting the app does not cancel your subscription.
  • Refunds: Refund requests are handled by the relevant store (Apple or Google) under their policies. FreshMate cannot issue direct refunds for store charges.
  • Right of withdrawal exception: Under applicable consumer law for digital content/services performed immediately, with your prior consent and acknowledgment that the right of withdrawal may be lost, the right of withdrawal may not apply once performance has begun. Store refund/withdrawal procedures remain governed by the stores.

5.7 Household Sharing and Premium

Household sharing is a FreshMate Premium feature. The subscription is linked only to the purchasing account; household members do not inherit premium status unless they purchase their own subscription.

Members' ability to view or edit shared inventory depends on role. This model may be updated without prior notice; binding behavior is in-app and in the current version of these Terms.

6. Acceptable Use

You agree not to:

  • Use the Service unlawfully, fraudulently, or in violation of third-party rights
  • Bypass or attempt to break freemium limits, subscription verification, or security controls (e.g., manipulating client-side premium_status)
  • Reverse engineer (decompile/disassemble) the app or circumvent obfuscation — except where legally required
  • Overload our servers or APIs with automated tools (bots, scrapers) or attempt denial of service
  • Install malware or attempt unauthorized access to other users' household/inventory
  • Share, rent, or resell account credentials
  • Create accounts with false, misleading, or others' identity information

We may suspend or terminate your account without prior notice for violation of these Terms (see §16). We reserve the right to pursue legal remedies for abuse.

7. User Content and Household Sharing

  • You retain ownership of inventory data and content you enter ("User Content").
  • You grant us a non-exclusive, worldwide, royalty-free license to use User Content to provide the Service (hosting, processing, sync with household members). This license is only for operating the Service; we do not use your content for advertising or third-party marketing.
  • You are responsible for whom you invite to a household and that invitees may view or edit shared inventory according to their role. Viewers cannot change inventory. FreshMateis not liable for household members' actions (incorrect data, deletion, etc.).
  • You are responsible for the accuracy of product names, categories, and expiration dates you enter.

8. Intellectual Property

The FreshMate name, logo, branding, UI design, source code, and software belong to us or our licensors and are protected by intellectual property law. These Terms grant you only a limited, non-exclusive, non-transferable license for personal, non-commercial use. No other rights are granted, expressly or impliedly.

9. Third-Party Services

The Service integrates with third parties including Supabase, RevenueCat, Apple, Google, Firebase (Google), OneSignal, and Google ML Kit. Use may be subject to their terms. We are not liable for outages, data loss, or disruptions from those providers beyond our reasonable control.

10. OCR and Receipt Scanning Disclaimer

Receipt scanning uses Google ML Kit on-device; you may alternatively paste receipt text manually. OCR may produce incorrect product names, quantities, prices, or dates. Always verify recognized information before saving. FreshMate is not liable for incorrect OCR, decisions based on it, or resulting waste, financial loss, or health issues.

11. Not Food Safety or Medical Advice

FreshMate is an organization and reminder tool only. Expiration estimates, category suggestions, and notifications are not food safety, nutrition, or medical advice. The final decision on whether food is safe to consume is yours. FreshMate is not responsible for health issues, food poisoning, or harm from consuming or discarding food based on app information.

12. Notifications

The Service may send local and remote (via OneSignal) notifications for expiration alerts and service messages. You may disable notifications in device settings; some features (reminders) may be limited. We are not responsible for delayed or undelivered notifications (network, OS, third-party infrastructure).

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation, accurate OCR, no data loss, or timely delivery of all notifications.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • FreshMate is not liable for indirect, incidental, special, punitive, or consequential damages; loss of profits, data, goodwill, or business interruption, whether in contract, tort, or otherwise.
  • Our total liability for any claim relating to the Service shall not exceed (a) the total amount you paid us in the twelve (12) months before the claim, or (b) USD 50 equivalent in Turkish Lira, whichever is higher.
  • For users on the free tier, total liability is zero (0) to the extent permitted by law.

Some jurisdictions do not allow certain limitations; in those cases liability is limited to the narrowest extent permitted. This section does not exclude liability for intent or gross negligence where law forbids.

15. Indemnification

You agree to indemnify and hold harmless FreshMate, its officers, and employees from claims, damages, losses, and reasonable legal fees arising from:

  • Violation of these Terms
  • Misuse or unlawful use of the Service
  • Infringement of third-party intellectual property or other rights
  • Any activity or content through your account

16. Suspension and Termination

  • By you: You may stop using the Service and permanently delete your account via Settings → Delete Account.
  • By us: We may suspend or terminate your account without or with notice for violation of these Terms, suspected abuse, legal requirement, or discontinuation of the Service.
  • On termination, provisions that by nature should survive (payment obligations, disclaimers, limitation of liability, indemnity, dispute resolution) remain in effect.
  • Account termination does not entitle you to a refund of subscription fees already accrued (see §5.6).

17. Force Majeure

FreshMate is not liable for delay or failure to perform due to events beyond reasonable control, including natural disaster, war, terrorism, cyberattack, power/internet failure, outages by third-party providers (Apple, Google, Supabase, Firebase, OneSignal, RevenueCat), regulatory changes, or similar events.

18. Changes to Terms

We may update these Terms from time to time. Updates are published at https://www.thedynamicstudios.com/en/apps/freshmate/terms (EN) and https://www.thedynamicstudios.com/tr/apps/freshmate/terms (TR). Material changes may be communicated via in-app notice or email. Continued use after changes means acceptance; if you do not accept, stop using the Service and delete your account.

19. Assignment

You may not assign your rights or obligations under this Agreement without our prior written consent. FreshMate may assign this Agreement with notice in connection with merger, acquisition, or sale of assets.

20. Severability and Waiver

If any provision is held invalid or unenforceable, the remainder remains in effect; the invalid provision will be interpreted to closest match the parties' intent. Failure to enforce a right is not a waiver.

21. Entire Agreement

These Terms and the referenced Privacy Policy constitute the entire agreement between the parties regarding the Service and supersede prior oral/written agreements. Apple/Google standard end-user license terms (see §23) apply in addition to these Terms.

22. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Republic of Turkey (without conflict-of-law rules). For consumer disputes, Consumer Arbitration Committees and Consumer Courtsat the consumer's residence or place of transaction have jurisdiction; otherwise Istanbul Courts and Enforcement Offices have jurisdiction.

For consumers in the EEA/UK, mandatory consumer protection remains; you may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

23. Apple and Google Specific Terms

  • If you obtained the App from the Apple App Store, Apple's standard EULA also applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
  • Apple and Google are not parties to this Agreement and have no warranty or support obligation for the Service. Contact us for Service questions; contact the store for billing/store issues.
  • Apple has the right to enforce this Agreement as a third-party beneficiary under App Store Terms.
