SoftPaper Terms of Service

Please read these Terms of Service Agreement ("Agreement", "Terms") carefully before downloading or using the SoftPaperapp ("App", "Service"). By downloading or using the App, you declare that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not accept these Terms, do not use the Service.

1. Parties and Subject of the Agreement

This Agreement is entered into electronically between SoftPaper (The Dynamic Studios)("we", "us", "our") and the user ("User", "you") and governs the terms of use of the Service, paid subscription conditions, and the rights and obligations of the parties.

2. Scope of the Service

SoftPaper is an iPadOS application for iPad, designed for digital planning, handwritten note-taking, notebook page creation, Apple Pencil drawing, and custom paper templates (daily, weekly, monthly layouts).

Features may vary by iPad model, app version, and region. SoftPaper is an organization and creative tool provided for personal use. No user account is required — all notes and drawings stay on your iPad.

3. Eligibility and Usage

• You must be at least 13 years old (or the minimum age required in your country) to use the Service. If under 18, you must use the Service with parent or guardian consent.
• SoftPaper uses a Local-First architecture. You are responsible for maintaining your device security and creating backups (via iCloud) for your handwritten notes and drawing data.
• SoftPaper does not offer user accounts or cloud sync. Deleting pages or uninstalling the app removes local data from your iPad.

4. Subscriptions, Fees, and Auto-Renewal

4.1 Premium Subscriptions

SoftPaper offers full access to planning, note-taking, and drawing features through auto-renewable subscriptions:

Current prices, free trial period details (if applicable), and subscription benefits are displayed in-app before purchase on the paywall screen.

4.2 Payment Processing

• Purchases are charged through the App Store via your Apple ID.
• Subscription status is verified using RevenueCat. We do not collect or store credit card details directly.

4.3 Auto-Renewal & Price Changes

• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Renewal fees are charged within 24 hours prior to the end of the current period.
• Price Changes: We reserve the right to modify subscription prices with prior notice in accordance with Apple App Store rules.

4.4 Free Trial

If a 7-day free trial is offered, you will be charged the selected plan fee when the trial ends unless canceled at least 24 hours prior to expiration. Free trial eligibility is managed by Apple and limited to once per Apple ID.

4.5 Cancellation & Refunds

• Cancellation: You may manage or cancel your subscription at any time via Settings → Apple ID → Subscriptions on your iPad. Deleting the app does not automatically cancel your active subscription.
• Refunds: Refund requests are evaluated directly by Apple under App Store policies. SoftPaper cannot issue direct refunds for store-processed transactions.

5. Acceptable Use Policy

When using SoftPaper, you agree not to:

• Attempt to circumvent subscription verification or reverse engineer payment or subscription checks.
• Reverse engineer, decompile, or disassemble the App binaries.
• Resell or commercially redistribute the application assets or code.

Violation may result in immediate suspension or termination of your access to the Service.

6. User Content & Data Ownership

• You retain 100% ownership of all handwritten strokes, drawings, plans, and notebook content created in SoftPaper.
• All notes are stored locally on your iPad. SoftPaper is not responsible for data loss resulting from device damage, uninstallation, or lack of personal device backups.

7. Intellectual Property Rights

The SoftPaper name, logo, UI/UX designs, code, and graphic assets belong to The Dynamic Studios and are protected under national and international intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license for personal, non-commercial use.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOFTPAPER AND THE DYNAMIC STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, OR LOSS OF DATA ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE LAST 12 MONTHS OR USD $50, WHICHEVER IS HIGHER.

10. Governing Law & Jurisdiction

This Agreement is governed by the laws of the Republic of Türkiye. For any legal disputes, the Courts and Execution Offices of Istanbul, Türkiye shall have exclusive jurisdiction, subject to mandatory local consumer protection laws.
